Liability Waiver and Release Form for participation in Classes held by EcoChef Academy

1. Assumption of Risk:  

I understand that my participation in the cooking classes is voluntary. I am/my child participant is in good health and suffer from no physical or mental condition that would make them/me especially susceptible to injury or illness while participating in the cooking classes, except as otherwise disclosed to EcoChef Academy.  

2. I understand it is my responsibility to inform EcoChef Academy during registration of any allergies and special needs that the participant may have, before participation in the cooking class(es).  Where possible, our instructor will accommodate dietary constraints. Allergies are the responsibility of the attendee and not of EcoChef Academy.  We are unable to take responsibility for allergic reactions to foodstuffs. Food prepared both on and off-site may contain traces of food allergens. 

3. Release and Waiver: 

I understand that participation in cooking activities involves certain inherent risks, including but not limited to burns, cuts, and other potential injuries associated with kitchen equipment, utensils, and cooking processes. I voluntarily assume all risks for myself/my child participant associated with participation in the program and release and discharge EcoChef Academy, its instructors, employees, and the Bradley Center from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or illness sustained by myself or the minor participant. EcoChef Academy is not responsible for any theft that may occur during classes.

4. Indemnity: 

I agree to indemnify and hold harmless EcoChef Academy, its instructors, and the Bradley Center from any liability, any loss, damage, expenses, claims, demands, actions, or causes of action or injury including death that I may suffer, or that my next of kin may suffer arising from my or the minor participant's participation in the programming at EcoChef Academy. I accept personal responsibility for myself or my child participating in classes for any liability, injury, loss, or damage that may arise from participation.  

I hereby waive, release, and forever discharge Monica Bradbury doing business as EcoChef Academy, The Bradley Center and insurers (the “Releasees”) from any and all claims, actions, damages, liabilities, losses, costs, and expenses (including, without limiting to, solicitor/client fees) for any injuries, losses or damages in any way arising out of my participation in the classes offered by the Academy. 

This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction. I hereby for myself, my heirs, executors, administrators and assigns release, save harmless and indemnify all persons comprising the EcoChef Academy and Monica Bradbury doing business as Eco Chef Academy,  their respective agents, instructors, volunteers, or anyone else on their behalf, (the Releasees) as well as The Bradley Center from and against any and all existing and future claims, actions, costs, expenses and demands in respect to death, injury, damage, loss or expenses to my person or property, whether foreseen or unforeseen and wheresoever and howsoever caused, I hereby acknowledge having read this release and waiver and by accepting I understand and accept its terms. 

By registering for services and accessing this website, customers are acknowledging theory have read and acknowledged the terms and conditions and liability waiver and release form on the website and agree to the terms.  

By registering for services and/or accessing ecochefacademy.ca or EcoChef Academy social media pages customers are acknowledging THIS LIABILITY WAIVER AND RELEASE FORM  and are AWARE THAT BY SIGNING  or using a digital form when registering for classes to acknowledge they have read and agree to terms of use.  By  using this site or signing up for classes individuals are  WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
